Terms & Conditions

These Terms & Conditions (the “Terms”) are a binding agreement between GET WOW EXPERIENCES AND GIFTS INC. (“WOW,” “we,” “us,” “our”) and any person who accesses or uses getwow.ca and related pages (the “Site”) or purchases/participates in any experience, service, or product offered through the Site (collectively, the “Services”). By accessing the Site, clicking Book Now, Checkout, Message Us, or otherwise using the Services, you agree to these Terms and our Privacy Policy (available at /privacy-policy). If you do not agree, do not use the Site.
1) About WOW
WOW is a curated marketplace and affiliate platform for experiences, events, and services (each an “Experience”). Some Experiences are provided or operated by independent third‑party suppliers (the “Suppliers”).
For Experiences identified as Supplier‑Provided, WOW is not the operator and does not control the delivery of the Experience. Your contract for that Experience is with the Supplier and their terms may apply in addition to these Terms.
WOW may also display affiliate links (e.g., to Viator). If you click through and book on a third‑party site, your purchase is governed by that third party’s terms and privacy policy. WOW may earn a commission; this does not change your price.
2) Eligibility & accounts
You must be at least 18 years old to use the Site or book an Experience. You represent that you have legal capacity to enter contracts.
You are responsible for safeguarding your account credentials and for all activity under your account. Provide accurate information and keep it updated.
3) How bookings work
Requests & acceptance. Placing an order or booking request is an offer to purchase the relevant Experience. Acceptance occurs when you receive a written confirmation from WOW or the Supplier (email, on‑screen, or in‑app).
What’s included. Inclusions, exclusions, meeting points, age/fitness requirements, and any special conditions are shown on the Experience page or in the confirmation. Read them carefully before purchase.
Your responsibilities. You agree to arrive on time, comply with instructions, and meet eligibility/health and safety requirements. You are responsible for your guests or group members.
4) Prices, payments & taxes
Prices & currency. Prices are shown before checkout and are generally in CAD unless noted. Taxes, fees, and surcharges (if any) will be displayed at checkout.
Payment processing. Payments are processed by third‑party providers. You authorize WOW and/or its processor to charge your payment method for the total amount and any authorized adjustments (e.g., permitted reschedules, add‑ons).
Anti‑fraud. Transactions may be declined, canceled, or refunded if suspected fraud or abuse is detected.
Errors. We may correct obvious errors (e.g., typographical or pricing mistakes). If you do not wish to proceed after a correction, you may cancel for a full refund.
5) Cancellations, changes & refunds
A) Supplier‑Provided Experiences
The Supplier’s cancellation, change, and refund policy applies. It will appear on the Experience page or in the confirmation. WOW will help facilitate communications but is not responsible for Supplier decisions.
B) Weather, safety & force majeure
WOW or a Supplier may modify, delay, or cancel an Experience due to weather, safety concerns, government action, or events beyond reasonable control. If this happens, we will attempt to offer a reschedule or a refund consistent with the applicable policy.
6) Gift cards & vouchers
Gift cards/vouchers may be redeemed only for eligible Experiences as described on the Site. They are not redeemable for cash.
Lost or stolen codes may not be replaced.
7) Risks & conduct
Many Experiences involve inherent risks (e.g., outdoor activities, sports, travel, kitchens, studios). You acknowledge these risks and agree to participate responsibly.
You are solely responsible for assessing your (and your guests’) fitness/health suitability and for following all instructions, eligibility rules, and safety requirements.
You must not engage in illegal, unsafe, disruptive, or abusive behavior. Suppliers may refuse service or remove participants who pose risks or breach rules, without refund where permitted by policy.
8) Reviews, photos & other user content
If you submit reviews, ratings, photos, or other content (“User Content”), you grant WOW a worldwide, non‑exclusive, royalty‑free license to host, use, reproduce, modify for formatting, and display your User Content in connection with the Site, social channels, and marketing.
9) Acceptable use
You agree not to:
Violate laws or third‑party rights; post or transmit unlawful, defamatory, or harmful content.
Use the Site to arrange unlawful activities or to circumvent Supplier policies or eligibility rules.
10) Intellectual property
The Site and its content (text, graphics, logos, design, software, and compilations) are owned by WOW or its licensors and are protected by intellectual‑property laws. All rights reserved.
Trademarks and brands of Suppliers remain their property. You may not copy, distribute, modify, or create derivative works except as expressly permitted.
11) Third‑party services & messaging apps
The Site may link to third‑party services (e.g., Viator, Stripe) and messaging apps (e.g., Telegram). Your use of those services is governed by their terms and privacy policies.
WOW is not responsible for third‑party acts or omissions.
12) Limitation of liability
WOW will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill.
13) Internet agreements & confirmations
Before you pay, key disclosures (price, taxes/fees, inclusions, restrictions, cancellation terms, identity of Supplier if applicable) will be presented on the Experience page and/or checkout.
After purchase, you will receive a confirmation that includes the final details and a link to these Terms and the Privacy Policy.
14) Changes to the Services & Terms
We may update the Site or Services and may modify these Terms from time to time. The date at the top shows the latest version. Changes take effect when posted. Your continued use means you accept the updated Terms.
15) Dispute resolution; governing law
If a dispute arises, please email contact@getwow.ca with a short description.
These Terms are governed by the laws of Ontario, Canada, without regard to conflict‑of‑law rules. You consent to the exclusive jurisdiction of the courts located in Toronto, Ontario for disputes not subject to informal resolution.
